Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) are a legal agreement between you (“you”, “your”, “User”) and Pyntexia (Pty) Ltd (“Pyntexia”, “we”, “us”, “our”), the company that owns and operates Qevya. By creating an account or using the Qevya platform, you agree to these Terms in full. If you do not agree, do not use Qevya.

2. Description of Service

Qevya is an AI-powered business management platform that helps small business owners manage client conversations, extract orders and invoices, and communicate with clients across messaging channels including WhatsApp Business, Instagram Business, Facebook Messenger, Telegram, Viber, and Email.

Qevya is a business tool intended for use by business owners and their authorised team members. It is not a consumer messaging application.

3. Eligibility

To use Qevya you must:

• Be at least 18 years of age
• Be a registered business owner or authorised representative of a business
• Have the legal authority to connect messaging channels on behalf of your business
• Not be prohibited from using the service under applicable law

4. Account Registration

When you create a Qevya account you agree to:

• Provide accurate and complete information
• Keep your account credentials confidential
• Notify us immediately of any unauthorised access to your account
• Be responsible for all activity that occurs under your account

You may not share your account with others or create accounts on behalf of third parties without authorisation.

5. Subscription Plans and Billing

5.1 Plans

Qevya offers the following subscription tiers:

• Starter: Free forever, one WhatsApp Business channel, limited features
• Basic: Paid subscription, any one channel, full features
• Growth: Paid subscription, any two channels, additional features
• Pro: Paid subscription, all six channels, all features

5.2 Free Trial

Paid plans (Basic, Growth, Pro) include a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you must subscribe to continue using paid features.

5.3 Billing

Billing details, pricing, and payment processing are governed by our payment processor's terms. All prices are displayed in your local currency for reference and billed in South African Rand (ZAR). Prices are subject to change with 30 days' notice.

5.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods except where required by applicable law.

6. Acceptable Use

You agree to use Qevya only for lawful business purposes. You must not:

• Use Qevya to send spam, unsolicited messages, or harassing communications
• Connect channels you do not own or have authorisation to use
• Attempt to reverse engineer, copy, or reproduce any part of the Qevya platform
• Use Qevya to violate the terms of service of any connected messaging platform (WhatsApp, Instagram, Facebook, Telegram, Viber, or email providers)
• Circumvent any security measures or access controls
• Use Qevya in any way that violates applicable law, including data protection laws

7. Your Data and Content

7.1 Ownership

You own your data. This includes your client information, conversation data, orders, invoices, and all business information stored in Qevya. We do not claim any ownership over your content.

7.2 Licence to operate the service

By using Qevya, you grant Pyntexia a limited, non-exclusive licence to process your data solely for the purpose of providing you with the Qevya service. We do not use your data for any other purpose.

7.3 AI processing

You acknowledge that Qevya uses artificial intelligence to analyse your business conversations and generate replies, summaries, and insights. You remain responsible for all communications sent from your connected channels, including AI-generated replies. We recommend reviewing AI-generated content before sending where commercially important.

7.4 Data export and deletion

You may export your data from the Settings page at any time. Upon account closure, your data will be deleted within 30 days in accordance with our Privacy Policy.

8. Third-Party Messaging Platforms

Qevya integrates with third-party messaging platforms. Your use of those platforms (WhatsApp, Instagram, Facebook, Telegram, Viber, Gmail) is governed by their respective terms of service. Pyntexia is not affiliated with, endorsed by, or responsible for those platforms. Changes to those platforms' APIs or policies may affect Qevya's functionality.

Where you connect a Gmail account, your use of that connection is also subject to Google's Terms of Service (policies.google.com/terms) and the Google API Services User Data Policy (developers.google.com/terms/api-services-user-data-policy), including its Limited Use requirements. Qevya's use of information received from Gmail APIs adheres to this policy.

9. Service Availability

We aim to provide Qevya with high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice where possible. We are not liable for losses caused by service downtime, third-party platform outages, or events outside our reasonable control.

10. Intellectual Property

The Qevya platform, including its design, software, brand, and content, is owned by Pyntexia (Pty) Ltd and protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from any part of the Qevya platform without our written consent.

11. Disclaimer of Warranties

Qevya is provided “as is” and “as available”. To the maximum extent permitted by law, Pyntexia disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Qevya will be error-free or that AI-generated content will be accurate.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Pyntexia's total liability to you for any claims arising from your use of Qevya shall not exceed the amount you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

13. Indemnification

You agree to indemnify and hold harmless Pyntexia (Pty) Ltd from any claims, damages, or costs (including legal fees) arising from your use of Qevya, your violation of these Terms, or your violation of any third party's rights.

14. Termination

We may suspend or terminate your account if you violate these Terms, fail to pay applicable fees, or if required by law. You may terminate your account at any time from the Settings page. Upon termination, your right to use Qevya ends immediately.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa. If you are an EU resident, you retain the right to bring claims before the courts of your country of residence.

16. Changes to Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Your continued use of Qevya after that date constitutes acceptance of the updated Terms.
